Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Cluby, a software platform for managing sports academies (“the Service”). By creating an account, registering a player, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Cluby is used by sports academies (“Clubs”), their staff, and the guardians and players registered with a Club. Staff accounts are created and managed by the Club. If you are registering a player who is a minor, you confirm that you are their parent or legal guardian and are authorized to provide their information.

Cluby provides tools for a Club to manage players, staff, sessions, and related records, and to communicate with members. Cluby is a software provider to each Club — it is not a party to the relationship between a Club and its players, guardians, or staff, and is not responsible for a Club’s coaching, scheduling, or membership decisions.

Cluby does not process payments and does not collect, store, or handle payment card or bank details. Membership fees and other payments are arranged directly between a Club and its members, outside the Service. Cluby only provides tools for a Club to record and track payments it has already received, for its own bookkeeping.

You are responsible for keeping your account credentials confidential and for all activity under your account. Notify your Club or Cluby immediately if you suspect unauthorized access. Some accounts (including platform administration) require additional verification steps, which you must not attempt to bypass or disable.

You agree not to:

• Use the Service for any unlawful purpose, or to store or share content you don’t have the right to;
• Attempt to access another Club’s data, or any account that isn’t yours;
• Interfere with or disrupt the Service’s normal operation, or attempt to bypass its security controls;
• Use automated means to extract data from the Service beyond normal use.

Clubs and their staff are responsible for the accuracy of the information they enter about players, guardians, and staff, and for having any consents needed to enter and process that information. A Club may export or request deletion of its data; see our Privacy Policy for how we handle personal data.

We aim to keep the Service available and reliable, but we don’t guarantee uninterrupted access. Features may change, be added, or be removed over time as the Service evolves.

Using the Cluby website and platform means you fully accept these Terms. Cluby may change the site’s content and these Terms at any time, to keep up with legal, regulatory, or technical developments; changes are announced by updating the “Last updated” date above.

You agree to use the site in line with the laws in force and not to harm its proper operation. Cluby is not responsible for:

• Temporary interruptions of the site caused by maintenance;
• Technical failures beyond its control;
• Indirect damages resulting from the use of the site.

We may suspend or restrict a Club’s access to the Service — including for non-payment of a Club’s own subscription to Cluby, or a violation of these Terms — with notice to the Club where reasonably possible. A Club may stop using the Service at any time.

The Service is provided “as is”, without warranties of any kind. To the maximum extent permitted by law, Cluby is not liable for indirect, incidental, or consequential damages arising from your use of the Service.

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Continuing to use the Service after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of Algeria, without regard to its conflict-of-law principles.
